A five-member constitutional bench (CB) of the Supreme Court (SC), headed by Justice Aminuddin Khan, on Thursday sent the appeal filed against the imprisonment of Baloch Yakjeti Committee (BYC) chief Dr. Mahrang Baloch to the Practice and Procedure Committee.
Speaking during the hearing, Mahrang’s lawyer Faisal Siddiqui said that a regular bench, and not the constitutional bench, was supposed to hear the case.
He went on to say that interpretation of the constitution had not been sought in the appeal.
Agreeing with the lawyer, Justice Amin said, “Okay. We refer the matter to the Practice and Procedure Committee.”
A month ago, an anti-terrorism court (ATC) in Quetta denied the police further physical remand of Mahrang and other BYC members, sending the political prisoners on judicial remand instead.
The case was heard by ATC Judge Muhammad Ali Mubeen in Quetta. The BYC leaders were arrested on March 22, on allegations of “attacking” the Quetta Civil Hospital and “inciting people to violence”.
