Rejecting the appeal filed by chief secretary (CS) Balochistan, the Federal Constitutional Court (FCC) on Saturday declared the notification issued for granting additional perks and privileges to former CSs of Balochistan for lifetime null and void.
The notification had been issued following the approval given by Balochistan chief minister.
In a four-page verdict, Justice Aamer Farooq said that every act done against law had no justification.
He said there was no room in law for giving additional perks and privileges to the wives and widows of retired or deceased chief secretaries. “However, they can get pensions and other privileges in accordance with the law after retirement,” the judge added.
It was further stated in the decision that it was the finance department, not finance minister or a chief secretary, which was tasked with framing rules with respect to salaries, perks and privileges and pension.
“In the present case, the provincial chief minister approved additional privileges, which is against law,” read the verdict.
Earlier, the Balochistan High Court had declared the notification null and void.
Following that, the provincial government had approached the FCC against the high court’s decision.
