A judicial magistrate indicted two Pakistan Muslim League (PML-N) workers in 5-year-old case of throwing ink and eggs on Pakistan Tehreek-e-Insaf (PTI) leader Shahbaz Gill in Lahore High Court, it was reported on Wednesday.
PML-N workers Mian Ghulam Abbas and Tariq Jatt indicted after 5 years. Judicial Magistrate Saad-ur-Rehman indicted PML-N workers.
The third accused named in the case, Ateeq, has died while appearing in court. The court summons witnesses from the New Anarkali police in the case next week.
Meanwhile, Lahore High Court acquitted an accused Shah Muhammad, who was sentenced to life imprisonment in a murder case.
Chief Justice Alia Neelam has declared the trial court’s conviction null and void. The 12-page judgement has been declared a judicial precedent. The prosecution failed to prove the guilt of the accused beyond reasonable doubt.
According to the verdict, there were several serious inconsistencies in the FIR and the prosecution’s story. The identity parade was not as per legal requirements and was not credible.
The witnesses had not described the identity or appearance of the accused in the FIR. The delay and shortcomings in the evidence raised serious doubts about the prosecution’s case.
The court also declared the forensic evidence and the recovery of weapons unreliable. The benefit of doubt is the legal right of the accused, not a concession.
The court ordered the immediate release of the accused, Shah Muhammad, as he was not wanted in any other case. The plaintiff’s review petition for enhancement of the sentence was also rejected.
The decision was issued by Chief Justice Alia Neelam, accepting the appeal of Shah Muhammad, accused in the murder case.
