Declaring the petition filed against the appointment of Saman Rafat Imtiaz as the Islamabad High Court (IHC) judge inadmissible for the hearing, the IHC on Tuesday termed the application an attempt to malign judiciary and to infringe upon its freedom.
In a two-page document, Justice Arbab Muhammad Tahir noted that the tendency to attack the dignity of judiciary was extremely unfortunate, and that the petitioner should be careful in future.
The judge further said that extremely insulting allegations were levelled against the judge in the petition, which were baseless and unverified, and prima facie fell in the category of contempt of court.
These allegations, the judge added, were either related to the judge’s conduct or court proceedings.
He went on to say that there existed various forums where appeals could be filed against a court’s decision, while the Supreme Judicial Council was authorized to probe alleged misconduct on the part of a judge.
Kalsoom Khaliq Advocate had filed the petition against the appointment of Justice Saman, while the Registrar Office had raised objections to it.
Justice Saman had been transferred to the Sindh High Court a few days ago.
